Gift voucher/card terms and conditions

• Payment by the accepted methods must be cleared and received in full by New Look for all orders where an agreed credit account facility has not been approved by New Look in writing and in all instances where the first few orders are being placed before Gift Vouchers and/or Gift Cards are sent for delivery.
• Where an agreed credit account facility is provided at the discretion of New Look, payment must be received by New Look within 28 days from date of invoice. Late payment of amounts due will result in interest being charged on overdue balances at 2% per annum above the HSBC Bank plc base rate accruing on a daily basis, orders will be suspended until payment has been received in full and discount offered will be removed.
• The price for the Gift Vouchers and/or Gift Cards shall be exclusive of delivery charges which are set out as applicable on the Order Form.
• Discounts will be in accordance with published levels or if above these levels shall be mutually agreed in writing.
• New Look shall use all reasonable endeavours to despatch Gift Vouchers and/or Gift Cards within 2 complete working days from receipt of order or receipt of cleared payment if no agreed credit account facility is in place although no guarantee is given by New Look that delivery shall be made within that timescale.
• Gift Vouchers and/or Gift Cards will be delivered by secure delivery. All deliveries will be made to the customer's specified address in the United Kingdom.
• Risk will pass to the customer upon delivery and title will pass on receipt of payment in full.
• Customers must notify New Look of non-delivery as soon as is reasonably practicable and in any case within 72 hours of the order being placed. Any discrepancy between Gift Vouchers and/or Gift Cards delivered and ordered must be notified to New Look within 72 hours of delivery. In these instances, New Look will investigate the matter in a reasonable time frame and report back to the customer. If the customer fails to notify New Look within 72 hours it shall be deemed to be conclusive evidence that the Gift Vouchers and/or Gift Cards have arrived undamaged and complete and the Gift Cards will become activated unless specified otherwise on the Order Form.
• Gift Vouchers and/or Gift Cards must not be sold on to any third party or subsequent purchaser at a discount against the face value unless agreed in writing by New Look.
• Gift Vouchers and/or Gift Cards are not supplied on a sale or return basis and cannot be exchanged or refunded for cash.
• All intellectual property (patents, patentable rights, copyright, design rights, utility models, trade marks (whether or not any of the above are registered), trade names, rights in inventions, rights in data, database rights, rights in know-how and confidential information, and all other intellectual and industrial property and similar or analogous rights existing under the laws of any country and all pending applications for and right to apply for or register the same (present, future and contingent, and including all renewals, extensions, revivals and all accrued rights of action) and other rights in the Gift Vouchers, Gift Cards and New Look name are the exclusive property of New Look and its group companies (any subsidiary, subsidiary undertaking or holding company for the time being of New Look or any holding company, subsidiary or, subsidiary undertaking for the time being of that holding company. Holding company has the meaning set out in Section 736 and Section 736A of the Companies Act 1985) and may not be used by or on behalf of the customer without the written consent of New Look.
• Conditions of use for Gift Vouchers and Gift Cards can be found on the reverse of the Gift Vouchers and Gift Cards supplied.
• New Look will hold any personal data (as defined in the Data Protection Act 1998) and customer data obtained in accordance with relevant legislation. Personal data will not be passed to any other organisation unless it is necessary to do so to fulfil obligations in providing the goods. Your data may be used to send you further information about New Look products and services and if you would prefer this not to happen, please tick this box ڤ.
• New Look shall not in any circumstances be liable for any consequential or indirect loss or damage suffered by the customer as a result of any breach by New Look of any of these Terms and Conditions.
• Breach of these Terms and Conditions will entitle New Look to discontinue supply immediately and seek legal remedy.
• These Terms and Conditions will supersede all others in the event of any dispute.
• English law applies to these Terms and Conditions and the parties agree to submit to the exclusive jurisdiction of the English courts.
• New Look is New Look Retailers Limited (Company Number 1618428) whose registered office is at New Look House, Mercery Road, Dorset, DT3 5HJ.
• The customer is the purchaser of the Gift Vouchers and/or Gift Cards.
